Liability Waiver & Terms of Service

I, the dog owner or handler identified below (“Client”), enter into this Waiver and Agreement with Cooper Canines LLC, including its owners, employees, contractors, agents, and representatives (“Trainer”). I assert that I am the legal owner (or authorized representative) of the dog(s) being trained or serviced (“Dog”).

1. Assumption of Risk & Release of Liability

Dog training involves inherent risks including but not limited to bites, injury, property damage, and unpredictable behavior. The Client voluntarily assumes all risks associated with participation in training, provided materials, or related activities. The Client agrees to release, indemnify, defend, and hold harmless the Trainer from any and all claims, demands, damages, losses, costs, attorney fees, or liabilities, including those brought by third parties and participants, arising from or in connection with the training services, the Client, or the Dog. The Client agrees to cover any financial expenses resulting from any incident involving the Dog during training or services. The Client warrants that the training location is safe and secure, and understands the Trainer is not responsible for injuries, loss, or damages from the conditions or layout of the premises.

2. Health, Safety & Veterinary Care

The Trainer may take any reasonable measures necessary to ensure the Dog's safety and health while under the care of Cooper Canines LLC. The Trainer has the right to refuse service at any time for any reason.

2.A. Expectations: The Client certifies the Dog is healthy, free of contagious conditions, and up to date on required vaccinations (including Rabies). The Client agrees to fully disclose the Dog’s complete behavioral and training history. Failure to disclose history, or address safety risks, may result in suspension or termination of service.

2.B. Veterinary: The Client accepts full responsibility for all veterinary costs resulting from or caused by the Client’s Dog. The Client authorizes the Trainer to seek emergency veterinary care at the Client’s expense if the Trainer reasonably believes such care is necessary. The Client agrees to reimburse all related costs, including transportation.

3. Scope of Services

The Trainer provides private lessons or individualized programs and will make a reasonable effort to teach the Client how to work with the Dog. Sessions take place at the Client’s home, public locations, or other mutually agreed-upon settings based on schedule availability. The Trainer prioritizes force-free, positive reinforcement methods, and will not use tools that cause pain or intimidation. The Trainer makes no express or implied guarantees regarding behavioral outcomes or performance. Successful outcomes depend heavily on the Client’s consistent effort, participation, and adherence to protocols. The Trainer reserves the right to refer clients to third-party professionals (such as a veterinarian or behavior specialist) at the Client's expense if needs exceed the Trainer’s scope.

4. Payments, Cancellations & Expirations

4.A. Payment Terms: Fees are due at registration or as otherwise agreed in writing by the Trainer. Training rates may vary and additional charges may be incurred based on location, session duration, or training complexity. Electronic payments may incur up to a 2.5% processing surcharge. Returned or failed payments incur a $35 fee. Invoices are provided electronically by default. The Trainer reserves the right to modify or discontinue promotional programs at any time without prior notice.

4.B. Refunds: All payments are non-refundable once the first session commences. Cancellations made 48+ hours prior to the first session may be eligible for a partial refund less administrative fees. Unused or missed sessions are non-refundable and non-transferable.

4.C. Scheduling & Expiration: 24-hour notice is required to cancel or reschedule a session; shorter notice forfeits the session. All training packages expire six (6) months from the purchase date. The Trainer is not liable for delays or failure to perform services due to events beyond reasonable control. Make-up sessions are at the Trainer's discretion and not guaranteed. Excessive cancellations, no-shows, or unpaid balances may result in suspension or termination of services.

5. Media

Subject to the preferences below, the Client grants Cooper Canines LLC permission to use photos, audio, or video of the Client or the Client’s Dog taken during training for media, educational, promotional, or safety purposes. Cooper Canines LLC will not share home location or private information with third parties. The Client waives any right to inspect or approve media. Consent may be revoked in writing for future media only.

If any clause is held unenforceable, all remaining provisions stay in full force. Legal disputes shall be governed exclusively by New Jersey courts. By signing below, the Client acknowledges having read, understood, and agreed to the terms of the waiver, including the waiving of certain legal rights. The Client acknowledges having had the opportunity to ask questions regarding this Agreement prior to signing.

Conditional Addendum

The terms of this Addendum apply only if the Client utilizes conditional or expanded services, including vehicle transport of the Dog (between personal property, the Trainer’s location, or public spaces), boarding, daycare, private training sessions conducted without the Client present, group settings, or socialization in public areas. The payment, cancellation, and expiration terms outlined in the main Liability Waiver apply equally to these additional services.

I acknowledge there are additional risks involved with environments that may contain other dogs, people, open spaces, or unknown hazards. I accept all risks of participating in public spaces and/or group settings, including encounters with dogs, wildlife, traffic, and known or unknown risks. I bear full responsibility for any unforeseen incidents, damages, or care requirements that occur while the dog is in the custody of the Trainer. I will be responsible for providing the Trainer with requested supplies and accept alternatives used by the Trainer or refusal of service if items were not provided. I authorize vehicle transport of my dog when required for services, and hold the Trainer harmless for any transit-related incidents.

If my dog is not picked up at the agreed time and all attempts by the Trainer to reach both me and my Emergency Contacts are unsuccessful for 24 hours, the dog may be deemed abandoned and transferred to local animal control or a rescue facility. I remain responsible for all accumulated costs. If I am unable to receive my dog in the agreed time-frame, I accept double the current hourly rate and that there is an additional $100 fee for each overnight stay.

I authorize the below individuals to act as emergency contacts and to pick up my dog on my behalf without requiring separate prior permission. All authorized individuals must present an official state or drivers license ID upon pickup.
